Terms of Service

1. Who we are
UPPOST ("the service") is operated by Your Time To Smile BV, trading as Barry Builds, with registered office at Nieuwrodese Steenweg 13, 3200 Aarschot, Belgium, VAT/enterprise number BE 0663 937 086. Contact: hello@yourtimetosmile.be.
2. What the service does
UPPOST is a web tool that helps athletes and active people create sport-specific shareable posts (image, title, caption) from a session summary, intended for sharing to platforms such as Strava and social networks. UPPOST is not affiliated with, endorsed by, or sponsored by Strava or any other third-party platform.
3. Accounts
Some features require an account. You are responsible for keeping your credentials secure and for activity under your account. You must be at least 16 years old to create an account.
4. Pricing & billing
- Lifetime (€49): one-time payment that grants access for the lifetime of the product (see clause 5).
- Monthly (€6/month): recurring subscription, charged monthly until you cancel.
- Yearly (€60/year): recurring subscription, charged yearly until you cancel.
Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your account; cancellation stops future renewals and access ends at the end of the paid period. Prices are shown in EUR. Where VAT applies, it is calculated and shown at checkout.
5. "Lifetime" definition
"Lifetime" refers to the lifetime of the product — i.e. for as long as we continue to operate UPPOST. It does not refer to the natural life of the customer or any company/domain. We will provide reasonable advance notice if the product is permanently discontinued.
6. Acceptable use
You agree not to:
- Upload content you do not have rights to.
- Use the service to harass, defame, infringe IP, or break applicable law.
- Attempt to bypass paid access controls, reverse-engineer the service, or abuse rate limits.
7. Intellectual property
We retain all rights in the service. Content you upload (photos, session data) remains yours; you grant us a limited licence to process and display it so we can deliver the service to you.
8. Service availability
We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features with reasonable notice.
9. Liability
To the maximum extent permitted by law, our aggregate liability for any claim relating to the service is capped at the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages. Nothing in these terms excludes liability that cannot be excluded under Belgian law.
10. Governing law & disputes
These terms are governed by the laws of Belgium. The courts of Leuven, Belgium have exclusive jurisdiction, subject to mandatory consumer protection rules that may give you the right to bring proceedings in your country of residence. EU consumers may also use the European Commission's ODR platform.
11. Changes to these terms
We may update these terms. Material changes will be notified through the service or by email. Continued use after changes take effect constitutes acceptance.
